The Board makes its decisions available for the public to read.

Search Board Decisions

The Board makes three types of decisions:

  1. Reasons for Decision
  2. Letter Decisions
  3. Order

 

Reasons for Decision

The Board will issue Reasons for Decision when the decision contains an important or new explanation of the law.  For example, Reasons for Decision inform readers of a new development of the law, a new interpretation of a law, or the application of the law to a new fact situation that the Board has not seen before. Parties regularly rely on Reasons for Decision to convince the Board to decide a certain way. For example, parties can rely on Reasons for Decision that have similar facts to their own case to convince the Board that it should interpret and apply the law in the same way. 

You can find Reasons for Decision by going to the Advanced search feature in the decision database and then selecting Reasons for Decision under Decision type. 

Letter Decisions

The Board will issue a Letter Decision when the decision does not add anything new to the development of the law. Letter Decisions are used to inform the parties of the decision. They are not available on the Board’s website, but they are available to the public on demand.

Orders

The Board issues orders when it certifies a union as the bargaining agent for a bargaining unit.  

You can find Bargaining Unit Orders by going to the Advanced search feature in the decision database and then selecting Bargaining Unit Order (CLCI) under Decision type. 

The Board issues other types of orders, such as Confidentiality Orders, Production Orders, and Orders related to illegal strikes or lockouts. These Orders are not available on the Board’s website, but they are available to the public on demand.

Certification Orders under the Status of the Artist Act 

Certification Orders under the Status of the Artist Act are available on the Board’s website on the Certification Register under the Status of the Artist Act

Each Certification Order defines the sector that the Board found suitable for collective bargaining and identifies the artists’ association that will represent it.   

Decisions available on the Board’s website

The decisions available in the decision database are divided into four collections:

Canada Labour Code, Parts I, II and III

This collection contains:

  • decisions and orders made by the Board under Part I (Industrial Relations) and Part II (Occupational Health and Safety) since January 1, 1999; and 
  • decisions and orders made by the Board under Part III (Standard Hours, Wages, Vacations and Holidays) since July 29, 2019. 

Status of the Artist Act

This collection contains:

  • decisions and orders made by the Board since April 1, 2013; and 
  • decisions made by the Canadian Artists and Producers Professional Relations Tribunal prior to its responsibilities being transferred to the Board on April 1, 2013.

Wage Earner Protection Program Act

This collection contains:

  • decisions and orders made by the Board since July 29, 2019.

Occupational Health and Safety Tribunal Canada 

This collection contains:

  • decisions made by the Occupational Health and Safety Tribunal Canada from 1992 until 2022, when it issued its last decision (the Tribunal’s responsibilities under Part II of the Canada Labour Code were transferred to the Board on July 29, 2019).

All Reasons for Decision issued by the Board are available from other sources. Reasons for Decision issued by the Canadian Artists and Producers Professional Relations Tribunal are also available on LexisNexis Quicklaw.
