Wage Earner Protection Program

An employee who is owed wages from a bankrupt or insolvent employer can claim them under the Wage Earner Protection Program

Service Canada is responsible for deciding whether an applicant is eligible for a payment and determining the amount of the payment.   If an applicant disagrees with Service Canada’s decision about their eligibility, they need to first ask Service Canada to review the decision.   

In reviewing amounts paid to an applicant under this Program, Service Canada sometimes finds that the applicant was paid too much.  When this happens, Service Canada will notify the applicant and ask that the over-payment be repaid.  If the applicant does not agree with Service Canada, they must ask Service Canada to review the decision.

The Board hears:

  • Appeals of review decisions on eligibility made by Service Canada; and
  • Appeals of review decisions on overpayments.
